OUT-OF-DATE REGISTRATION<\/h2>\n\n<p><strong>Problems with a farm&#8217;s registration<\/strong> may include incorrect data on the size of the property, outdated information on the owners or the absence of records of recent changes, such as improvements or subdivisions (dismemberments).\nAdministrative changes, such as the creation of new municipalities or alterations to territorial boundaries, may also not be reflected in the registration. <\/p>\n\n<p>In addition, <strong>Law 10.267\/2001 requires<\/strong> rural properties <strong>to be geo-referenced<\/strong>, which means that failure to comply with this requirement can prevent the regularization and sale of the property.<\/p>\n\n<p>These inconsistencies can cause <strong>blockages in the transfer of ownership by the notary&#8217;s office, generating significant delays in the sale process<\/strong>.\nIn addition, the lack of accurate information can result in <strong>complex litigation<\/strong>, such as disputes between unknown heirs or creditors who have not been registered correctly, <strong>prolonging the negotiation and increasing legal costs<\/strong>. <\/p>\n\n<h2 class=\"wp-block-heading\">2. TRESPASSING<\/h2>\n\n<p>Trespassing can result in significant risks for property owners, including <strong>usucaption<\/strong>, which allows property to be acquired in situations of prolonged and uninterrupted possession.\nIn Brazil, the minimum time to claim usucapi\u00e3o is usually <strong>5 years<\/strong>, but this can vary.\nTo resolve this, it is possible to start a <strong>repossession<\/strong> process, but this can be time-consuming and costly.  <\/p>\n\n<p>An alternative to resolving invasions would be through <strong>informal agreements<\/strong>, which may seem like a quick fix, but carry <strong>risks of legal uncertainty<\/strong>.\nThese agreements may not have a solid legal basis, creating future uncertainty and setting <strong>dangerous precedents<\/strong> that encourage new invasions. <\/p>\n\n<h2 class=\"wp-block-heading\">3. UNAVAILABILITY<\/h2>\n\n<p>A farm is considered unavailable when it faces legal obstacles that prevent or hinder its sale.\nThere are situations in which usufructuaries, for example, have <strong>the right to use the property, but not the right to sell it<\/strong>. <\/p>\n\n<p>There are also cases of <strong>seizure<\/strong>, when the property is used as collateral to pay debts in legal proceedings, and <strong>fiduciary alienation<\/strong>, which binds the property to a loan, preventing its transfer until the debt is paid off.<\/p>\n\n<p>These situations require <strong>complex legal and administrative solutions<\/strong>, which can delay the sale and increase costs for the seller.<\/p>\n\n<h2 class=\"wp-block-heading\">4. CHAIN OF OWNERSHIP<\/h2>\n\n<p><strong>Reconstructing the chain of<\/strong> ownership <strong>of<\/strong> a property is essential if it is to be sold.\nThe process involves documenting the entire history of property transfers that the farm has had over the years, going back from its current situation to its <strong>original title<\/strong>, which transferred ownership from the state to private hands.\nIf there are <strong>gaps or inconsistencies in the chain of ownership<\/strong>, legal issues can arise that complicate or delay the sale.  <\/p>\n\n<p>These flaws can <strong>raise doubts about the legitimacy of the title<\/strong>.\nIn addition, reconstructing the chain of title can be a time-consuming process, requiring extensive dealings with notaries and the search for old and scattered documents. <\/p>\n\n<h2 class=\"wp-block-heading\">5. ENVIRONMENTAL LIABILITIES<\/h2>\n\n<p><strong>Environmental liabilities<\/strong>, which include obligations such as the regularization of legal reserve areas or fines, in Brazil are governed by the <strong>right <em>propter rem<\/em><\/strong>, i.e. they are <strong>automatically transferred to new owners in the event of a sale<\/strong>.<\/p>\n\n<p>These requirements can be a determining factor for buyers, who <strong>inherit the responsibilities of regularization<\/strong>.\nSuch situations can involve <strong>significant costs and the need to comply with<\/strong> strict environmental <strong>requirements<\/strong>, influencing the purchase decision and the perceived value of the property. <\/p>\n\n<h2 class=\"wp-block-heading\">8. PRICE INCOMPATIBLE WITH THE MARKET<\/h2>\n\n<p>Considering the qualities of a rural property, advertising its sale at a price far <strong>removed from<\/strong> those practiced by the market can <strong>turn off interested parties or result in lengthy and frustrating negotiations<\/strong>.<\/p>\n\n<p>To determine a value that is in line with expectations, but also <strong>competitive<\/strong>, the best option is to rely on a <strong>well-founded valuation methodology<\/strong>.\nThis methodology, offered by specialized professionals, will take into account factors such as location, size, land use, market conditions and other relevant aspects. <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>9.
